These general terms and conditions apply to all orders placed with Scraps via our webshop mottainai-labs.com. By placing an order, you agree to these terms and conditions.

Definitions

  • Consumer: Any natural person acting for purposes outside his trade, business, craft or professional activity.
  • Services/Products: The Mail Club subscriptions and other goods supplied by Scraps.
  • Agreement: Any agreement between Scraps and the Consumer for the delivery of Services/Products.
  • Mail Club: A subscription plan consisting of a monthly physical shipment (letter, photo print, and extra items).

Scope of application

These General Terms and Conditions apply to every offer from Scraps and to every distance contract concluded between Scraps and the Consumer. Deviations from these terms and conditions are only binding if agreed upon in writing.

Offer and agreement

  • The selection in our webshop is non-binding. Scraps reserves the right to change prices and remove products from the assortment.
  • An agreement is concluded as soon as the consumer places an order and receives an order confirmation via email.
  • Scraps reserves the right to refuse an order or to impose additional conditions.

Agreement Duration and Automatic Renewal

The Mail Club is offered as a subscription of 3, 6 or 12 months This subscription includes a monthly mailing of a physical package (the Mail Club letter, a photo print, and two extra items).

  • Initial duration: The agreement is entered into for the chosen period (3, 6 or 12 months).
  • Automatic renewal: If notice is not given in time (minimum 14 days for the next automatic payment), the agreement will be tacitly renewed for an indefinite period. The automatic debit will continue to take place according to the chosen term (every 3, 6 or 12 months).
  • The consumer can cancel the subscription at any time via the“My account” page on the website.
  • During the first term:The notice of termination must be given no later than 14 days to be passed on for the next automatic payment. In this case, the consumer receives the Mail Club packages until the end of the initial period already paid (3, 6 or 12 months).
  • After tacit renewal: As soon as the subscription has been converted to an indefinite term, the consumer can cancel at any time with a notice period of maximum one month. The consumer will only receive the packages that fall within this cancellation period. Any subscription fees paid in excess (for the months following the cancellation period) will be refunded to the consumer by Scraps.
  • Notification:Scraps reminds the consumer of the upcoming renewal and the option to cancel it via email no later than one month before the automatic renewal.

Price and Payment

  • All stated prices are expressed in EURO, always including VAT and all other taxes or levies that the Consumer is obliged to bear.
  • If delivery, reservation, or administrative costs are charged, this will be stated separately.
  • The stated price applies exclusively to the items as described verbatim. The accompanying photos are for decorative purposes only and may contain elements that are not included in the price.
  • The price for the subscription is invoiced periodically. According to the subscription plan selected during the ordering process via the payment method chosen by the consumer (SEPA direct debit, credit card, etc.).
  • In the event of a failure to pay, Scraps reserves the right to suspend delivery or service provision following a notice of default, granting the Consumer a further period of 14 days to fulfill the payment obligation.
  • All sales are final. No refunds will be issued unless the items are damaged or the error is on the part of Scraps. In such cases, we will work together to find a suitable solution.

Registration deadline and First Delivery

  • The Deadline: The Mail Club operates on a monthly cycle. To ensure administrative and logistical processing, Scraps maintains a final order date of the 20th of the current month.
  • Order on or before the 20th: If the consumer signs up and makes the first payment on or before the 20th of month A, the first Mail Club shipment will be received in month B (the following month).
  • Order after the 20th: If the consumer registers after the 20th of month A, the first delivery is postponed by one month. The consumer will then receive the first shipment in month C.

To avoid confusion, we use the schedule below for the start of your subscription:

  • Example 1: You register for 15 April This is before the deadline of April 20. You will receive your first Mail Club package at the beginning of May.
  • Example 2: You register for 22 April. This is after the deadline of April 20. Your registration is pushed back by one month. You will receive your first Mail Club package at the beginning. June.

Delivery, delivery time

  • Dispatch: The monthly Mail Club newsletter is published every time and sent on the 15th of every monthto the address you provided.
  • Delivery address: The Consumer is responsible for providing the correct postal address via email hi@mottainailabs.com. Additional shipping costs due to an incorrect address are the responsibility of the Consumer.
  • Delivery delays: Scraps is not liable for delays caused by the postal service or unforeseen circumstances.
  • Longer delivery times may apply for international shipping outside of Belgium. 
  • Risk transfer: The risk of loss or damage passes to the consumer only at the moment the goods are physically received by the consumer or a third party designated by the consumer (not the carrier).
  • Damage upon receipt: If a product is delivered damaged by the postal service/carrier, the consumer must report this immediately (no later than 48 hours) after receipt via email hi@mottainai-labs.com.
  • Evidence: To claim replacement or compensation for transport damage, the consumer must provide proof in the form of clear photos of:
    • The damaged packaging (outer side).
    • The shipping label on the box, if applicable.
    • The damage to the product itself.
  • Solution: In the event of a substantiated report of transport damage, Scraps will send a replacement product free of charge. If replacement is not possible, the purchase amount for that specific product will be credited.

Warranty and conformity

  • Scraps guarantees that the products comply with the agreement, the specifications in the offer, reasonable requirements of soundness, and legal regulations.
  • Any defects or incorrectly delivered products must be reported to us in writing within 3 days of delivery.

Liability and Personal Responsibility (Foraging)

  • Informative Nature: The information in the Mail Club newsletter regarding flowers, plants, herbs, and mushrooms is intended solely for educational and informational purposes. Although Scraps compiles the information with the utmost care, its accuracy or completeness is not guaranteed.
  • Deductible for Picking and Preparation: The Consumer is at all times solely responsible for the correct identification of plants or mushrooms in the wild. Scraps is not responsible or liable for the manner in which the consumer picks, processes, or prepares the products.
  • Medical and Physical Exclusion: Scraps is not liable for:
    • Allergic reactions or other health problems resulting from the consumption of or contact with the described crops.
    • Physical strain or injury sustained while picking or applying the information.
    • Incorrect use of techniques, recipes, or instructions provided in the letter.
  • Exclusion of liability: To the fullest extent permitted by Belgian law, Scraps disclaims all liability for indirect damage (including poisoning, illness or injury) or consequential damage (such as loss of profit or missed opportunities) arising from the use of the information provided or the incorrect following of the advice.
  • Local Legislation: The consumer is responsible for complying with local laws and regulations regarding foraging (such as respecting nature reserves and property rights).

Applicable law

  • These general terms and conditions are governed exclusively by Belgian law.
  • Any disputes fall under the jurisdiction of the courts of the district of Antwerp.

Intellectual Property

  • Right of ownership: All intellectual property rights relating to the Mail Club newsletter, the website, and the images, texts, videos, logos, and recipes posted thereon belong exclusively to Scraps or its licensors.
  • Limited Right of Use: The Consumer obtains a personal, non-exclusive, and non-transferable right of use with respect to the provided information (the Mail Club letter) for strictly private use.
  • Prohibition of Reproduction: The Consumer and website visitor are expressly prohibited from:
    • To copy or distribute the content of the Mail Club letter (texts, illustrations, photos), whether or not for payment.
    • to download, reproduce, or use images, texts, or videos from the website for your own (commercial) purposes without prior written permission from Scraps.
    • To use the information for organizing your own workshops, commercial guided tours, or publications based on the specific composition of the content of Scraps.
  • Infringement: Upon establishment of an infringement of these intellectual property rights, Scraps reserves the right to immediately terminate access to the services and to claim damages in accordance with applicable Belgian copyright law.

Changes to the general terms and conditions

Scraps reserves the right to amend these general terms and conditions. The amended terms and conditions will take effect for new orders after publication on the website.
